Release, Waiver & Release from Liability Policy

At Somaya, we offer life-improvement transformative programs that are dependent on engaging plant medicines which are sometimes regulated under national and local laws that require us to use appropriate standardized program assessment practices. Before participating in our therapy sessions including plant healing ceremonies, all participants must sign and date a release and waiver form containing the below clauses regarding liability, risks, and medical information accuracy. Please read the forms carefully to ensure you understand their contents before signing:

Liability

We accept multiple payment methods/exchanges on our website, therefore you may choose the plan that works best for you based on the specific needs of your retreat program. There are usually three (3) possible plans to choose from:

1. Somaya shall not hold liable to loss, damage, or theft of participant’s luggage/belongings while on property.

2. Somaya and staff accept no responsibility for personal injury or death of any kind while participating in any of the retreat programs that are held during the stay at the Somaya property.

3. Any form of noncompliance with the rules and expectations laid down orally, visibly, and in general by Somaya might disqualify the participate from energy-healing and any form of imposed treatment it provides to avoid inconsistencies.

The payment of these various plan tiers are handled by our payment gateway, where deposits will be automatically acknowledged alongside any progress reports towards achieving paid in full balance.

Risks

All guests are informed and duly warned of any potential hazards, dangers, or risks associated with the retreat programs’ activities and Site-related conditions before agreeing to parti-pate. Any risk associated must be considered and guided before partaking in programs that require participants to be immensely mentally-aware.

In choosing to participate in various energy healing methods offered by Somaya participants understand high levels of interaction with nature which increases the risk of injury/damage from natural/climate factors.

Medical Information

All participants are required to provide complete and comprehensive information regarding their current and their past medical conditions and concerns.

Participants will consent to treatments only when medical information has been represented to and approved by our relevant medical staff through prior agreement at the availability of amenability occurring at Somaya, under the terms of Somaya’s regulation. Somaya retains the rights to a refund claim if all necessary forms containing required medical information haven’t/were not supplied to the necessary parties.

As mentioned above, signatures and initials of participants will be required on our standardized waiver and liability release-form.We encourage you to reach out in case you have further questions or require more information to aid your decision-making around choosing our program.

Release from Liability Regarding the use of Plant Medicine

This website and the information it provides are designed for research purposes and personal awareness before working with plant medicine and participating in our retreat programs. Participants who choose to seek the healing benefits of plant medicine are responsible for their decision and understanding the critical responsibility necessary, especially given the sensitivity around such treatment.

We advise all participants to consult their primary healthcare provider and legal counsel before participating in plant medicine programs, to avoid any potential risks that could arise in the pre, during and aftermath of such treatment.

As such, participants opting to engage in our plant medicine ceremonies and retreat program do so at their discretion and thereby assume full responsibility for any risks associated with participation in these programs. By accepting the Terms and Conditions set forth before engaging in actions that compromise their responsibilities, participants relinquish any potentials of legal action being either taken by them against Somaya or against third party service, providers offering support services for not addressing active dangers that could otherwise result from unjustifiable decision making.

By browsing or participating in the Somaya website or taking part in the program activities that you would have paid for, you thereby accept this policy statement and accept your full responsibilities by hereby notifying Somaya that there will be no refunded action(s) against the organization or third-party service providers that are affiliated with our service provisions that you’ve agreed to adhere to.
